TERMS AND CONDITIONS OF RESERVATION/RENTAL

All Drivers must meet the minimum age of 25 years old, have a valid driver’s license, provide proof of auto liability and collision damage insurance in the U.S. Virgin Islands, and present a major credit card (Visa, Master Card, Discover) in his/her name at the time of rental. Children under 6 years old or less than 40 lbs. must use a children’s car seat or appropriate restraint.

AGREEMENT
This reservation/rental agreement is a contract between St. John Car Rental and the credit card holder, the primary driver. Only the person whose name appears on the credit card and is listed as the primary driver is allowed to pick up and sign for the rental vehicle and associated charges. If the primary driver’s name and the credit card holder’s name do not match, the reservation will be canceled.

RENTAL PICK UP
At the time of rental pick up, the same credit card used to book the vehicle must be presented along with a valid driver’s license in the same name. Your credit card will be charged in full for the rental rate based on the parameters entered during your online reservation. Changing your confirmed reservation parameters could result in a different rate. Your card may be charged for the remaining balance before you arrive at our rental office but not before the rental pick-up day listed on the reservation.

ADDITIONAL DRIVERS
All drivers (primary or additional) must meet the minimum age of 25 years old, have a valid driver’s license, and provide proof of rental car insurance coverage in the U.S. Virgin Islands. All drivers of the rental vehicles need to provide proof of insurance coverage in the U.S. Virgin Islands. Failure to provide proof of rental car insurance will result in the cancellation of your reservation.

AFTER HOURS
After 5:00 pm rental pick-ups are available by appointment only and with full flight information. Please provide your Airline, Flight #, and arrival time. You must arrive at our office within 2.5 hours after landing in St. Thomas on the day of your rental pick-up. If we do not have your flight information and your flight is delayed or arriving after 5 pm, your rental vehicle will be available by 8 am the following day. **Our office is closed on Christmas Day, New Year’s Day and July 4th. Pick-ups and returns are not allowed on these days.

AGE
All Drivers must meet the minimum age of 25 years old, have a valid driver’s license, a clean driving record, and present a major credit card (Visa, Master Card, Discover) in his/her name at the time of rental.

BUSINESS HOURS
Business Hours are 8:00 am to 5:00 pm. *Pick-up time starts a 1 pm. *Return time is by 11 am. **Additional fees will apply if the renter would like to pick up or return their rental vehicle earlier or later than the posted times. After 5:00 pm rental pick-ups are available by appointment only and with full flight information. Please provide your Airline, Flight #, and arrival time. Our office is closed on Christmas Day, New Year’s Day and July 4th. Pick-up and returns are not allowed on these days.

CANCELLATION POLICY
All reservations booked with St. John Car Rental require a non-refundable $100 pre-payment UNLESS one (1) of the following conditions are true during your rental dates:

  • Your vacation is canceled due to travel restrictions imposed by the US Virgin Islands (USVI) government.
  • St. Thomas airport closure due to hurricanes or other tropical weather.

IF your reservation meets one (1) of the criteria above, your options are:

  • Apply the $100 towards any future reservation.
  • Receive a full refund of your $100 pre-payment.
  • Does not apply to previously canceled reservations.

CLEANING
Vehicles returned with excess sand or trash will be assessed a $70 cleaning fee. Excess sand is determined if the rental vehicle has sand on the seats, in the cup holders, on the dash, or any other place other than the floor mats. To avoid additional fees it is recommended that you remove trash and vacuum out your vehicle before return.

DIRECTIONS
St. John Car Rental is conveniently located about a 90-second walk to the north (right) of the public ferry terminal.

DRIVER’S LICENSE
When picking up your rental the cardholder MUST be present with their valid driver’s license with the credit card that was used to reserve your vehicle. All drivers must appear at the rental counter with the primary renter and present a valid driver’s license.

OFFICE HOURS
St. John Car Rental is open from 8:00 am to 5:00 pm. If returning your vehicle outside of normal business hours, please park your vehicle in our lot and leave the key where instructed by your rental agent. Customers are responsible for their rental vehicle(s) until St. John Car Rental has opened and had a chance to inspect the vehicle.

GAS
Renters are asked to return their vehicle with the same amount of gas at the time of rental pick up. If returned with less than the same amount renters will be charged the price to refuel plus a $20 trip charge.

INSURANCE
USVI Law (Title 20 Section 418c) states that a rental car company’s auto insurance is secondary to the renter’s auto insurance. As such, this requires all drivers listed on the rental agreement (both primary and additional drivers) to provide proof of full coverage (liability and collision) in their name, issued by a US insurance company at the time of rental.

CREDIT CARD INSURANCE
If using credit card coverage a letter from your credit card company is required with verification of rental coverage. The same card used for the $100 payment must be used for the balance of the rental and presented at check-in for verification.

TRAVEL INSURANCE
If using travel insurance with rental car coverage it must include all covered drivers names, policy dates, and policy number. Failure to provide proof of coverage will result in cancellation of your reservation and forfeit of the $100 pre-payment.

BUSINESS INSURANCE
If using your company’s vehicle insurance policy, you must provide a list of the covered drivers under the policy in addition to verification of coverage for rental vehicles.

INTERNET RESERVATIONS
The person whose credit card is used to book the vehicle MUST be listed on the rental as the primary driver and present at check-in, they must also present their valid ID along with the credit card used to book the vehicle – No Exceptions. Anyone paying for the rental is required to be listed on the agreement.

NO-SHOWS
All NO Show customers will be charged a $150 cancellation fee. All cancellations must be done in writing via email at [email protected]

PAYMENT
We accept VISA, MASTER CARD and DISCOVER. We DO NOT accept American Express or Cash. Pre-Paid, Debit Cards, and virtual credit cards are not acceptable forms of payment.

PREPAID RESERVATIONS
This is a Prepaid Reservation. A Non-Refundable $100 payment is required to hold all reservations. The name on the credit card used to book this reservation MUST match the name on the reservation listed as the primary driver and be presented along with a valid driver’s license on the day of rental pick-up.

REFUNDS-EARLY RETURNS
No refunds for early returns. If the rental vehicle is returned earlier than the return day listed on the reservation or rental agreement, the renter is still responsible for the full amount listed on the rental agreement.

SMOKING
Smoking is not allowed in any rental vehicles. If the smell of any type of smoke is detected, renters will be charged a $250 cleaning fee.

TAXES AND FEES
A mandatory $3.75 per day “Road Tax” is automatically added to your rental agreement.

Parking
St. John Car Rental offers complimentary parking at our in-town location anytime after 5 pm. Parking is limited and available on a first-come first-serve basis. Please park ONLY in marked parking spots. Parking in unmarked spots may result in your vehicle being booted and fined up to $250. St. John Car Rental and its owners assume no responsibility for any theft or damage to vehicles parked on our property.

RETURNING THE VEHICLE

PARKING
You must return your rental vehicle in the same condition you received it, at the Designated Return Time and date identified in the rental Agreement. Any damages or extra time will be charged to the card on file.

ACCIDENTS/INCIDENTS
You must report to us at 340-776-6103 or [email protected] any accident/incident involving your rental vehicle as soon as it is safely and reasonably possible to do so. You may be asked to provide us with a written report, a police report, and otherwise cooperate in our investigation of the incident and recovery of damages. You must also immediately report to us at 340-776-6103 or [email protected] any incident or parking violation related to your rental vehicle. Failure to report tickets will result in additional late fees and administrative fees.

VEHICLE DAMAGE
If your rental vehicle is damaged, you will pay our estimated repair cost or the vehicle’s deductible. If costs exceed the stated deductible, your insurance company will be notified to cover the additional damages. Any charges that are more than the estimated damages will be refunded to the card on file.

You are also responsible for Loss of Use (“LOU”) of the Vehicle, which is defined as the applicable daily rate multiplied by the number of days taken to repair or replace the vehicle, not to exceed 30 days. Where permitted by Applicable Law, you authorize us to charge you for the actual cost of repair or replacement of lost or damaged items such as glass, mirrors, tires, and antenna, as part of your rental charges at the time of return. If the vehicle is stolen and not recovered, you will pay us the Vehicle’s fair market retail value before it was stolen. As part of our loss, you will also pay for loss of use of the Vehicle, without regard to our fleet utilization, plus an administrative fee and appraisal, plus towing and storage charges, and diminished value, if any (“Incidental Loss”). If your responsibility is covered by any insurance, payment card benefit, travel insurance, or such other insurance or benefits, you authorize us to contact the benefit provider directly on your behalf and you assign all of your benefits directly to us to recover all consequential and incidental damages, including but not limited to the repairs of the Vehicle plus diminished value or the fair market retail value of the Vehicle (less salvage value plus costs incurred in the salvage-sale), and all Incidental Loss and administrative fees. If we collect our loss from a third party after we have collected our loss from you, we will refund the difference, if any, between what you paid us and what we collected from the third party. If the Applicable Law of a jurisdiction covering this rental requires conditions on Loss Damage Waiver that are different from the terms of the Agreement, such as if your liability for ordinary negligence is limited by such Applicable Law, that Applicable Law prevails. You understand that you are not authorized to repair or have the Vehicle repaired without our express prior written consent and that if the Vehicle is repaired without our consent, you will pay the estimated cost to restore the Vehicle to the condition it was in before your rental, per Paragraph 3.5 below.

ACCIDENTS/DAMAGES
Renters are responsible for any new damages to their rental vehicle. USVI Law states that the renter’s insurance is primary, rental company’s insurance is secondary. Renters are required to notify and bring in their rental vehicle for inspection immediately or during business hours for inspection and to provide documentation for insurance. If the rental vehicle is deemed not rentable, customers are responsible for rental fees and damages.

IN THE EVENT OF AN ACCIDENT

  1. Call the police (911) immediately.
  2. Fill out a police report.
  3. Call St. John Car Rental to report the accident immediately.
  4. Renter agrees to pay for estimated damages before the return date listed on the rental agreement.
  5. If obtaining an estimate is not possible, due to weekend or holiday closures, the renter agrees to pay a $1,000 insurance deductible. If the estimated amount is less than the deductible, the renter will be refunded the difference when an estimate is obtained.
  6. Renter agrees to hold harmless and indemnify St. John Car Rental of any claim, suit, or expense resulting from his/her operation of a rented vehicle or his/her negligence while operating a rented vehicle.
  7. Renter agrees to pay for any and all lost rentals as a result of the vehicle being repaired.
  8. All disputes must be litigated in the U.S. Virgin Islands; renters will be responsible for their own attorney fees.
